The class claimed lobbyists wanted to use the information collected in the database to fight against firearms regulations.

The court concluded the defendant's argument that it "grew to realize the magnitude of the problem and, at the appropriate time, disclosed that information to regulators and investors is more plausible than any inference of scienter."

After Allianz publicly reported the data breach to the Office of the Maine Attorney General, the lawsuits began to pile up on July 28. Allianz allegedly began to send notice on Aug. 1 to inform those impacted by the breach.

While some anti-SLAPP attorneys wholeheartedly agreed with the decision and the way anti-SLAPP case law is developing in Connecticut, others say the decision did not provide complete clarity and left unanswered questions.

"The plain language of § 4-160 unambiguously puts the state in the same position as a private person once sovereign immunity is waived, and, at that juncture, the state retains all the rights and liabilities of a private person," the Supreme Court held.
