The North Dakota superintendent for public instruction could become the nation’s assistant secretary of education for the Office of Elementary and Secondary Education.

A sentencing hearing is set for March, according to court documents.

Andrea Travnicek served on the former governor's cabinet. She has been nominated to serve as one of his top officials.

The bill would honor North Dakota law enforcement officers who have died in the line of duty. That includes Fargo Officers Jason Moszer and Jake Wallin, as well as Mercer County Deputy Paul Martin.

The North Dakota governor will oversee agencies that administer policy on Native American affairs, national parks and energy leases.

Some legislators had concerns that the bill was just a concept and had no definitive fiscal note. Sen. Tim Mathern said the bill is needed to plan for the future.

Lawmakers had concern about a lack of policy and definitive cost of the program.
